Privacy Policy

This Privacy Policy (“Policy”) describes how The Strength Collective Galesburg (“we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information through our website (the “Site”) and related services (collectively, the “Service”). Your use of the Service constitutes your agreement to the terms of this Policy. If you do not agree with the terms herein, please do not access or use the Service.

“Sensitive Personal Information” or “SPI” means a subset of Personal Information that warrants heightened protection under applicable law and may include biometric data, precise geolocation data, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic or health-related data, sex life or sexual orientation, and other categories as defined by applicable law.

“Controller,” “Processor,” and “processing” shall have the meanings given under applicable state or federal privacy laws.

“Sale,” “share,” “profiling,” and other similar terms shall be construed in accordance with the applicable privacy law definitions in the jurisdictions in which we operate or target users.

“You,” “your,” or “User” means a natural person who uses the Service.

2. Scope and Applicability.

This Policy applies to all Personal Information we collect via the Service, and to all uses and disclosures of such information. It does not apply to information (a) collected offline or by a third-party unaffiliated with us, (b) de-identified or aggregated in such a manner that it cannot reasonably be re-identified, or (c) processed pursuant to separate privacy notices or agreements (for example, for employment or vendor relationships).
To the extent any state or federal law requires additional or different disclosures, we will comply with such law and this Policy shall be interpreted in a manner consistent with such requirements.

(b) Automatically Collected Information. 8. Sale or Sharing of Personal Information / Profiling / Targeted Advertising.
To the extent required by applicable law, we will provide clear disclosures and offer you the ability to opt-out of (or opt-in to) the sale or sharing of your Personal Information, profiling of your personal data in connection with targeted advertising, and any other processing that qualifies as a “sale,” “sharing,” or “profiling for decisions that produce legal or similarly significant effects” under relevant statute.

We retain your Personal Information for as long as necessary to fulfil the purposes described in this Policy, unless a longer retention period is required or permitted by law. Our Service is not intended for individuals under the age of 16 (or such higher age required by applicable law). 22. Arbitration and Governing Law
Any disputes relating to this Policy or our processing of your Personal Information shall be governed by the laws of the State of Texas (without regard to its conflict of law principles) and shall be subject to the dispute-resolution procedures set forth in our Terms and Conditions.

23. Severability
If any provision of this Policy is found to be invalid, illegal or unenforceable in any respect under present or future law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable while retaining the intent of the original provision, and the remaining provisions shall remain in full force and effect.

24. No Waiver
Our failure to enforce any right or provision under this Policy shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by us.
